Wenn der Vermieter ein Räumungsurteil erwirkt hat, muss der Mieter die Wohnung räumen. Wenn er das nicht freiwillig tut, wird der Gerichtsvollzieher eine Zwangsräumung durchführen. Was passiert dann mit dem Hausrat des Mieters und wer ist dafür verantwortlich?
Bislang gibt das Gesetz keine Antwort auf diese Frage. Der Umgang mit geräumten Gegenständen ist von Gemeinde zu Gemeinde unterschiedlich. Heute werden die Gegenstände oft vom Gerichtsvollzieher auf die Straße gestellt. Danach sorgen die meisten Gemeinden dafür, dass die Gegenstände entfernt und gelagert und nach einiger Zeit zurückgegeben oder vernichtet werden.
Viele Gemeinden erteilen dem Vermieter (und manchmal auch dem Gerichtsvollzieher) jedoch eine Anordnung gemäß der Gemeindeordnung, wenn er Gegenstände auf die öffentliche Straße stellt. Die Gegenstände müssen dann innerhalb einer bestimmten Frist unter Androhung einer Strafe entfernt (vernichtet/gelagert) werden. Dies wurde vom Gesetzgeber als unerwünscht erachtet, da der Vermieter in diesem Fall lediglich sein Recht durchsetzt und der Gerichtsvollzieher lediglich seine gesetzliche Pflicht erfüllt. Außerdem würde dies dazu führen, dass die Sachen früher vernichtet werden, um keine Strafe zahlen zu müssen.
Dies ändert sich ab dem 1. April 2021. Von da an wird ein dritter Absatz zu § 556(3) der Zivilprozessordnung hinzugefügt. Nach diesem Absatz liegt die Verantwortung für den geräumten Hausrat bei der Gemeindeverwaltung. Das Kollegium muss sich dann bei der Räumung einer Wohnung um den Abtransport und die Lagerung des Hausrats kümmern. Damit werden die Unterschiede auf lokaler Ebene nivelliert und die Frage auf nationaler Ebene geregelt.
Sehr praktisch ist, dass die neue Regelung nicht für den Vermieter gilt. Das liegt daran, dass die Hochschule den Hausrat auf Kosten des Vermieters entsorgt. Es ist also immer noch der Vermieter, der die Kosten für das Entfernen, die Lagerung und möglicherweise die Zerstörung der Gegenstände trägt. Die Idee ist, dass der Vermieter die entstandenen Kosten wiederum vom Mieter zurückfordert. Diese Kosten können vom Mieter auf der Grundlage des bereits ergangenen Räumungsurteils zurückgefordert werden. Die Erfahrung zeigt jedoch, dass es bei den meisten Mietern nichts zu holen gibt und der Vermieter mit leeren Händen dasteht.
Kurz gesagt: Vermieter/innen müssen nach dem neuen Gesetz keine Strafen mehr im Zusammenhang mit der Räumung/Lagerung einer geräumten Immobilie befürchten, aber sie müssen weiterhin für die Kosten aufkommen.
