Jusqu'à présent, la loi ne répond pas à cette question. La politique concernant les biens expulsés varie d'une municipalité à l'autre. Aujourd'hui, les objets sont souvent placés dans la rue par l'huissier, après quoi la plupart des municipalités veillent à ce qu'ils soient enlevés et stockés, puis restitués ou détruits au bout d'un certain temps.
Cependant, de nombreuses municipalités imposent au propriétaire (et parfois même à l'huissier) un ordre en vertu de l'ordonnance municipale pour avoir placé des objets sur la voie publique. Les objets doivent alors être enlevés (détruits/stockés) dans un certain délai sous peine d'amende. Le législateur a estimé que cela n'était pas souhaitable, car dans ce cas, le propriétaire ne fait que faire valoir son droit et l'huissier ne fait qu'accomplir son devoir légal. De plus, cela aurait pour effet de détruire les affaires plus tôt afin d'éviter d'être redevable de pénalités.
Cela a changé à partir du 1er avril 2021. Dès lors, un troisième alinéa sera ajouté à l'article 556(3) du Code de procédure civile. En vertu de cet alinéa, la responsabilité des effets ménagers libérés incombera à l'exécutif municipal. Le collège devra alors se charger d'emporter et de stocker les effets ménagers lors de l'expulsion d'une résidence. Cela permettra d'aplanir les différences au niveau local et de régler la question à l'échelle nationale.
Très pratique, la nouvelle disposition ne concerne pas le propriétaire. En effet, le collège prend en charge les effets ménagers aux frais du propriétaire. C'est donc toujours le propriétaire qui paie les frais d'enlèvement, de stockage et éventuellement de destruction des affaires. L'idée est alors que le propriétaire récupère à son tour les frais engagés auprès du locataire. Ces frais peuvent être récupérés auprès du locataire sur la base du jugement d'expulsion déjà rendu. Cependant, l'expérience montre qu'avec la plupart des locataires, il n'y a rien à récupérer et que le propriétaire se retrouve les mains vides.
En bref : les propriétaires ne risquent plus de sanctions en vertu de la nouvelle loi en ce qui concerne le déblaiement/entreposage d'un bien expulsé, mais ils devront tout de même en assumer les coûts.
